These Terms of Service ("Terms") govern access to and use of PhotoLuxie, including its website, photographer dashboard, hosted client galleries, file storage, client-delivery features, favorites, questionnaires, contracts with electronic signature, day schedules, downloads and related studio tools (together, the "Service").

In these Terms, "PhotoLuxie", "we", "us" and "our" refer to the business above. "Customer", "you" and "your" refer to the professional, business or organization that creates or uses a PhotoLuxie account.
You accept these Terms and the PhotoLuxie Data Processing Agreement ("DPA") when you tick the box for them while activating your account, or when you are asked to accept them in the dashboard. We keep a record of the version you accepted and the time of acceptance. If you do not accept them, you may not use the Service.
1. Business Use and Eligibility
PhotoLuxie is intended for photographers, videographers, studios and other professional users. By creating an account you confirm that:
- you are at least 18 years old and have legal capacity to enter into a binding agreement;
- you use PhotoLuxie for your trade, business or profession and not as a consumer;
- the information you give us is accurate and current; and
- if you act for a company, studio or other organization, you have authority to bind it to these Terms.
The Service is offered exclusively for business use, and we do not knowingly enter into contracts with consumers. If, despite this restriction, a user qualifies as a consumer under the law, these Terms do not limit the rights that the law gives that user on a mandatory basis, such as, where applicable, the right of withdrawal.
One email address can hold only one account, and disposable email addresses are not accepted.
2. The PhotoLuxie Service
PhotoLuxie lets Customers:
- upload and store photographs, videos and other supported files;
- create client galleries protected by an access code, and deliver them to clients;
- let clients mark favorite photos, including to choose photos for an album;
- offer full-gallery or selected downloads, including, where the optional Pro ZIP add-on is active, a prepared full-gallery download file;
- share questionnaires, contracts with electronic signature and day schedules with their clients;
- organize shoots, locations, notes, vendors, pricing guides and income/expense and VAT entries;
- customize branding and gallery presentation; and
- use other features we introduce from time to time.
The dashboard is available in Greek and English. Storage limits differ by plan. Unless agreed in a separate written agreement, PhotoLuxie does not guarantee a service level or uninterrupted availability.
3. Customer Accounts
You are responsible for keeping your login credentials confidential and secure. You must not share them with unauthorized persons, circumvent account or plan restrictions, attempt to access another Customer's account or data, or interfere with authentication, security or access-control systems.
You are responsible for activity carried out through your account, unless it results from a security failure attributable to PhotoLuxie. Tell us promptly at [email protected] if you believe your account has been compromised. We may require additional verification before security-sensitive account changes.
4. Plans and Storage
4.1 Free plan
The Free plan has no time limit. It is meant for accounts that are actually used: if a Free account has not been signed into for 180 days, we may warn you by email, and if you do not sign in within 30 days of that warning, the account and all its content may be permanently deleted. Signing in once is enough to keep it. Galleries on the Free plan show a "Powered by PhotoLuxie" mark.
4.2 Paid plans
Paid plans differ only in the storage they include, and each can be bought with or without the optional Pro ZIP add-on. Current prices are shown on the sign-up screen, on the Plan page of the dashboard and on the checkout page, and form part of your subscription agreement.
4.3 Storage limits
You must not intentionally circumvent storage, upload or other plan limits. If your account exceeds its limit, we may block new uploads, ask you to reduce usage or upgrade, or temporarily restrict affected features. We will not delete content merely because a storage limit has been exceeded, except under Sections 4.1, 6 and 7 or where immediate action is necessary for security, legal compliance or preventing abuse.
5. Fees, Payments and Automatic Renewal
Subscriptions are billed monthly in advance and renew automatically every month, using the payment method on the account, until cancelled. Prices include 24% VAT and are shown before payment. You are responsible for accurate billing and tax information.
Payment provider. Payments are processed by Stripe (Stripe Payments Europe, Limited, Ireland). Your card details are received and processed only by Stripe; PhotoLuxie never sees or stores your card number. You authorize PhotoLuxie and Stripe to charge the applicable fees.
Changing plans. You change plans through "Manage subscription" on the Plan page of the dashboard. A larger plan applies immediately, and the prorated difference for the rest of the current period is charged immediately. A smaller plan applies from the next renewal.
Refunds. Except where required by law, fees already paid are non-refundable.
Price changes. We may change prices. For an existing paid subscription we will give reasonable advance notice, and the new price applies from the first renewal after the notice period. You may cancel before that renewal if you do not accept the new price.
6. Cancellation
You cancel a subscription through "Manage subscription" on the Plan page of the dashboard. Cancelling stops the next renewal; the subscription stays active until the end of the paid period, with no refund for the rest of that period, and until then you can undo the cancellation.
When the subscription ends, the account moves to the Free plan. If your files fit in the Free plan's storage, everything carries on as normal. If they do not, the process in Section 7 applies until you choose a plan again or delete files so that they fit.
7. Unpaid Subscriptions, Suspension and Deletion
If a subscription payment fails, or if your files do not fit in the Free plan after a subscription ends:
- Days 1–3 — grace period. The Service works normally and we notify you by email.
- From day 4 — suspension. Your galleries close for your clients and the dashboard becomes read-only: you can see and download your content, but you cannot change anything. We notify you by email.
- From day 7 — possible deletion. On day 7 we notify you again by email. From the following day, the account and all its content, including photos, videos, galleries and client information, may be permanently deleted without further notice.
If you pay or choose a plan before deletion, your account and galleries reopen immediately.
Once content has been permanently deleted, it cannot be recovered. Database records may remain for up to 30 days in our database provider's point-in-time recovery, and in the database backups we keep to recover from a failure. They are not available for use and are restored only for genuine disaster recovery, in which case the deletion is re-applied. We do not keep a separate copy of your photographs or files.
We may keep limited account, transaction, billing, security or legal records where the law requires or permits it.
8. Customer Content
"Customer Content" means photographs, videos, files, gallery information, questionnaires, contracts and signatures, notes, schedules, vendor records, bookkeeping entries, client information, metadata and other material uploaded, submitted, stored or transmitted through the Service by or for a Customer.
Ownership. You keep all rights you have in your Customer Content. PhotoLuxie does not acquire ownership of it by storing it.
Limited license to PhotoLuxie. You grant PhotoLuxie a non-exclusive, worldwide, royalty-free license to host, store, copy, cache, transmit, display, resize, create previews, thumbnails and download archives from, and otherwise technically process Customer Content, only as far as necessary to provide the Service, deliver galleries and files to the recipients you authorize, provide support, secure the Service and comply with the law. The license ends when the content is permanently deleted.
No promotional use. PhotoLuxie will not use your photographs in advertising, portfolios, social media or public showcases without your permission.
No AI training. PhotoLuxie will not use your Customer Content to train artificial-intelligence or machine-learning models unless you have separately and expressly opted in.
9. Your Responsibility for Customer Content
You are responsible for the Customer Content you upload or process through PhotoLuxie. You confirm that, as far as the law requires, you have the rights, permissions and lawful basis to hold and use it, upload it, instruct PhotoLuxie to process it, and share it with your clients and other recipients.
PhotoLuxie does not check whether you have obtained the permissions, contractual rights, privacy notices or lawful basis you need from your clients or the people you photograph. Your relationship with your clients remains your responsibility.
Contracts with your clients. PhotoLuxie provides tools for writing and electronically signing contracts between you and your clients. PhotoLuxie is not a party to those contracts, does not provide legal advice, and does not guarantee their legal validity or enforceability. The signature captured is a simple electronic signature, not a qualified electronic signature.
Bookkeeping and VAT tools. The income/expense and VAT tools are an aid for your own organization. They are not tax or accounting advice, and they do not replace your accountant or your official tax filings.
10. Personal Data and Sensitive Information
Photographs may contain personal data and, depending on context, information that receives additional protection, such as religious beliefs or health. You may upload such material where its processing is lawful and necessary for your professional activity. You are responsible for determining whether the processing is lawful and whether any additional legal conditions are met.
Minors. Where Customer Content includes children, you are responsible for ensuring that photographing them, using their information and sharing it is lawful, and that the required notices and permissions are in place.
Facial recognition. The Service does not perform facial recognition or biometric identification.
11. Data Protection Roles
For personal data PhotoLuxie processes for its own purposes (account administration, subscriptions, billing, security and support), PhotoLuxie acts as controller, as explained in the PhotoLuxie Privacy Policy at https://app.photoluxie.com/legal/en/privacy.
For personal data contained in Customer Content that PhotoLuxie processes on your behalf, you act as controller and PhotoLuxie acts as processor. That processing is governed by the DPA, which forms part of these Terms.
12. Third-Party Providers
PhotoLuxie uses third-party providers for hosting, database, storage, email and payments. The current list is published at https://app.photoluxie.com/legal/en/services, and the ones that process Customer Personal Data are listed in Annex III of the DPA. We will notify you of changes as described in the DPA.
13. Gallery Access and Sharing
Each client gallery is protected by an access code. You decide who receives a gallery's link and code, when to close a gallery, and what it contains. PhotoLuxie cannot prevent a person who can view your material from copying, photographing, recording or redistributing it.
14. Acceptable Use
You must not use PhotoLuxie to store, distribute or facilitate material or activity that:
- is illegal;
- sexually exploits or abuses children;
- contains non-consensual intimate imagery;
- infringes copyright, trademarks or other intellectual-property rights;
- unlawfully violates another person's privacy or data-protection rights;
- contains malware or malicious code;
- facilitates fraud, phishing or credential theft;
- impersonates another person or business for fraudulent purposes;
- attempts to compromise, overload or interfere with PhotoLuxie or other systems; or
- circumvents security or access controls.
We may restrict activity that places an unreasonable technical burden on the Service or interferes with other Customers.
15. Content Moderation
PhotoLuxie is a hosting and professional workflow service. We do not inspect the photographs and files uploaded to it. We use automated technical measures only for security, rate limiting, abuse prevention and file validation; no decision about content is made automatically.
Authorized personnel may look at specific Customer Content only where necessary to investigate a report, answer a support request that requires it, investigate a security incident, comply with a legal obligation, or enforce these Terms.
Depending on the circumstances, we may leave content available, ask for information, restrict access, disable a file or gallery, remove content, or suspend or terminate an account. Our decisions are not arbitrary or discriminatory. Where we restrict your content or account, we will email you the reasons for the decision and how you can contest it, as required by Regulation (EU) 2022/2065 (Digital Services Act). You can contest a decision by replying to that email or writing to [email protected], and you always have the right to go to court.
16. Reporting Illegal Content
Anyone may report content hosted on PhotoLuxie that they believe is illegal, through the reporting form at https://app.photoluxie.com/legal/en/report or by email to [email protected]. A report should identify the exact gallery, page or link, explain why the content is believed to be illegal, include the reporter's name and email address (except for reports of child sexual abuse or exploitation, which may be made anonymously), and state that the information in it is accurate and that it is made in good faith.
We handle precise reports in a timely, diligent, objective and non-arbitrary way. Where a report includes an email address, we send an automatic confirmation of receipt straight away, and later inform the reporter of our decision and the available redress. A report does not automatically result in removal. Where we become aware, by any means, whether from a report or otherwise, of information giving rise to a suspicion that a criminal offence involving a threat to the life or safety of persons has taken place, is taking place or is likely to take place, we promptly inform the competent law-enforcement or judicial authorities and provide the relevant information available to us.

17. Intellectual-Property Complaints
If you believe Customer Content infringes your intellectual-property rights, report it as described in Section 16. Identify the protected work or right, the allegedly infringing material and its location, the basis of your claim, and your contact details. We may ask for additional evidence before deciding.
18. Suspension and Termination
We may suspend or terminate all or part of the Service where reasonably necessary because payment is overdue (Section 7), a Free account has stayed inactive after a warning (Section 4.1), you materially or repeatedly breach these Terms, your use creates a security risk or threatens the Service or other Customers, content or conduct is unlawful, the law or a binding order requires it, or the account is used fraudulently.
Where reasonable and legally permitted, we will give notice and an opportunity to fix the problem before terminating an account. Immediate suspension may occur for serious security, illegal-content or abuse concerns. When an account is terminated, its content is deleted as described in Section 7.
19. Keep Your Own Copies
PhotoLuxie is a client-delivery and workflow platform, not an archive. It keeps no separate backup of your photographs or files. Always keep your own copies of original and irreplaceable files. Download anything you want to keep before an account is closed or deleted.
20. PhotoLuxie Intellectual Property
The Service, including its software, design, interfaces, trademarks and documentation, belongs to or is licensed to PhotoLuxie. Except as these Terms permit, you may not copy or redistribute the Service, reverse engineer it (unless mandatory law allows it), remove proprietary notices, sell or sublicense access to it, use PhotoLuxie trademarks without permission, or build a competing service by copying PhotoLuxie's software or materials. None of this gives PhotoLuxie ownership of your Customer Content.
21. Feedback
If you give us suggestions or feedback, we may use them to improve the Service without compensating you.
22. Third-Party Services
PhotoLuxie relies on third-party infrastructure, email and payment providers. Some failures or interruptions may originate in systems outside our reasonable control.
23. Beta Features
Features clearly marked as beta or experimental may change, contain bugs, be discontinued, or be unsuitable for critical work.
24. Service Changes
We may improve, change, replace or discontinue features. If a change would materially reduce a core paid feature during a paid period, we will give advance notice where practicable.
25. Availability and Maintenance
We aim for a reliable service but do not guarantee it will be uninterrupted or error-free. It may be unavailable because of maintenance, security updates, infrastructure or third-party failures, emergency repairs, network failures or other events outside our reasonable control. Where practicable, we announce planned maintenance that is expected to cause significant downtime.
26. Disclaimer of Warranties
To the extent permitted by law, the Service is provided "as available". Except as expressly stated in these Terms or required by law, PhotoLuxie gives no warranty that the Service will be uninterrupted, that every feature or integration will remain available, that content will never be lost, or that the Service will meet your specific business requirements.
27. Limitation of Liability
To the extent permitted by law, neither party is liable to the other for indirect or consequential losses, including lost profits or business opportunities. PhotoLuxie's total contractual liability in any twelve-month period is limited to the greater of the fees you actually paid to PhotoLuxie in the twelve months before the event giving rise to the claim, or EUR 100. This does not limit liability for fraud, wilful misconduct or gross negligence, any other liability that cannot legally be limited, or either party's statutory data-protection obligations.
28. Your Responsibility for Claims
To the extent permitted by law, you are responsible for third-party claims arising from content you had no right to upload or use, unlawful instructions you gave about personal data, infringement of someone else's rights, unlawful use of personal data, a material breach of these Terms, or unlawful activity carried out through PhotoLuxie. You agree to cooperate reasonably with us in responding to such a claim.
29. Privacy and Cookies
The PhotoLuxie Privacy Policy explains how PhotoLuxie processes personal data for its own purposes. The Service uses only the cookies needed to keep you or your clients signed in, and one cookie that remembers the language you chose; it uses no advertising or analytics cookies, and the full list is in the Privacy Policy. Where PhotoLuxie processes personal data on your behalf, the DPA applies.
30. Changes to These Terms
We may update these Terms to reflect new or changed features, changes in the law, security or abuse-prevention needs, or changes to our business model. For significant changes we will tell you by email or in the dashboard, and we will ask you to accept the new version before you continue using the Service. The current version and its effective date are always available at https://app.photoluxie.com/legal/en/terms.
31. Communications
You agree that operational, billing, security, legal and account notices may be sent to you electronically, by email or through the Service, in the language you chose for the dashboard. Keep your account email address up to date. Marketing messages are separate and never a condition of using the Service.
32. Assignment
You may not transfer your rights or obligations under these Terms without our consent, except as part of a legitimate transfer of your business with reasonable notice. PhotoLuxie may transfer these Terms as part of a merger, restructuring or sale of the relevant business, subject to applicable law and data-protection obligations.
33. Force Majeure
Neither party is liable for a failure or delay caused by circumstances beyond its reasonable control, provided it takes reasonable steps to limit the impact. This does not excuse payment obligations that arose before the event.
34. Severability, No Waiver, Entire Agreement, Language
If a provision is found invalid, the rest remains in force, and the invalid provision is adjusted only as far as necessary to make it valid. Not enforcing a provision once does not waive it. These Terms, the order or subscription details, and the DPA form the entire agreement between you and PhotoLuxie about the Service. For the processing of Customer Personal Data, the DPA prevails in case of conflict.
These Terms are available in Greek and English. If the two versions differ, the Greek version prevails.
35. Governing Law and Jurisdiction
These Terms are governed by Greek law, without prejudice to mandatory EU law. The courts of Piraeus, Greece, have jurisdiction over disputes between PhotoLuxie and a Customer, unless mandatory law provides otherwise. Before going to court, the parties will try in good faith to resolve the dispute directly.
